Solar above 50 kW: prosumer or MIOZE — and why it is a trap

Expanding a PV installation looks like an obvious good: more panels, more free energy. But once you pass 50 kW something changes that the module vendor rarely mentions — and that can turn the investment into an expensive problem.

The same roof, entirely different rules

A typical situation: a site — a small shopping centre, say — has 50 kWp of solar on the roof, close to 100% self-consumption, reasonably well-organised consumption and settlement with a handful of tenants. Everything works.

Then an offer arrives to expand the PV to 150 kWp for several hundred thousand zloty. What often goes unsaid at signing: once past 50 kW the owner stops being a prosumer overnight and becomes a MIOZE — a small renewable energy installation. From that moment nobody talks to them as a prosumer any more; the settlement rules change, and the proposed agreement can be far less favourable.

More panels that do not earn

The problem is that adding capacity does not in itself mean greater benefit. If the site cannot consume the additional output, the surplus goes to the grid on terms that under the MIOZE regime can be markedly worse.

The result is an investor with more panels but nobody having shown them a path on which this new solar earns anything at all — let alone pays back. Battery storage, the reflex answer, is often not the solution at this form of activity and this scale, if only on cost grounds.

Look for the answer in the whole building, not on the roof

The way out usually lies not on the roof but in the site's whole energy profile. Instead of looking solely at production, it is worth looking at when and on what energy is consumed — and matching that consumption to production.

Cleverly raised self-consumption, load shifting (very often with refrigeration as the main lever) and a few less obvious moves can make even an "oversized" installation start to make sense. But that requires a plan for all the energy in the building, not one more quote for equipment.

Before you add panels, check your status and your profile

The moral is simple: before you add capacity to existing solar, check two things. First — whether you will cross the threshold that changes your status from prosumer to MIOZE, and what that means for settlement. Second — whether the site has any way of consuming the additional output at all. Without those answers, expanding PV can be not an investment but a new cost.
